If you are claiming universal credit, be careful that you do not inadvertently tick the box on the ESA50 form to give permission to see your medical records if they need to.

DWP will probably send your GP a ESA113 questionnaire, if you have given permission.

Remember... There is no legal requirement for a claimant to give consent for DWP to seek information from GPs and other parties. Claimants are free to withhold their consent and if they do, If consent is withheld DWP still has the legal right to arrange for a medical examination by an Examining Medical Practitioner using the Department’s contract for medical services with ATOS under section 19 of the Social Security Act 1998, however, by withholding consent, you could delay your application.

When you leave the EU, you lose your Article 8 Right to Privacy.

Currently under the protection of the EU, no-one can access your medical records without 'informed consent', but informed consent can be obtained in a number of ways!

The Home Office appears to be working with Department of Work ^ Pensions, to get access to records signed off.
